Sometimes being an honest broker of the legal truth will cause a potential client to seek legal advice elsewhere, and we understand that. We have come to the conclusion that it is better for us not to form a relationship and make promises that we can not keep than to be paid by a client for services that are not ultimately effective or beneficial. We have reached these conclusions because we know based on surveys going back to 1987 and before why people complain about lawyers. Of the total complaints that people have about lawyers and legal services 40% to 45% complain about neglect and non-communication by lawyers. We can assure all of our clients past, present and future, that when they come to our office we certainly will not ever neglect their case we will, despite the obstacles of other lawyers and court schedules stay on top of their legal issue until it is resolved. Of course non-communication by lawyers is completely unacceptable. We know in our practice how difficult that would be for a client, that is to contact your lawyers office and not receive a response in a reasonable manner. We as lawyers find it difficult when we try to contact other lawyers who represent opposing clients and do not get a prompt response! It is frustrating! So when you come to Davis and Davis expect that your case will be as important to us as it is to you and that when you contact us, you will get an answer, we can not promise it will always be the answer you want but it will be an honest answer and our best legal opinion.
The kind of case also will determine the number of complaints. For example, based on recent surveys, nearly one fourth of the complaints lawyers receive are in the area of family law and that is quite understandable. People involved in emotional divorces, custody, or support matters, are often frustrated not only by the legal system but by the lack of speed in resolving their matter. Unfortunately, most times, often because the courts treat family law matters as step-children, the cases take time and are quite difficult and emotionally draining not only to the clients but to the lawyers. General litigation normally receives about 16% of consumers complaints followed by criminal law at 12%, wills, estates and trusts and 9%, personal injury at 8%, real estate at 8%, and miscellaneous commercial litigation at about 5%.
